قَالَ: (وَلَوْ كَانَتِ الْقِسْمَةُ بِالْكُوَى فَلَيْسَ لِأَحَدِهِمْ أَنْ يَقْسِمَ بِالْأَيَّامِ، وَلَا مُنَاصَفَةً) ؛ لِأَنَّ الْحَقَّ ظَهَرَ بِذَلِكَ، فَيُتْرَكُ عَلَى حَالِهِ، إِلَّا أَنْ يَتَرَاضَيَا؛ لِأَنَّ الْحَقَّ لَهُمَا.
