قَالَ: (وَلَا بُدَّ فِيهَا مِنَ التَّأْقِيتِ) ؛ لِأَنَّهَا تَنْعَقِدُ إِجَارَةً ابْتِدَاءً، وَشَرِكَةً انْتِهَاءً. وَلِأَنَّهَا تُرَدُّ عَلَى مَنْفَعَةِ الْأَرْضِ وَالْعَامِلِ فَلَا بُدَّ مِنْ تَعْيِينِ الْمُدَّةِ كَالْإِجَارَةِ.
