(وَإِذَا صَحَّتِ الْمُزَارَعَةُ فَالْخَارِجُ عَلَى الشَّرْطِ) عَمَلًا بِالْتِزَامِهِمَا، قَالَ - عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ -: «الْمُؤْمِنُونَ عِنْدَ شُرُوطِهِمْ» .
