قَالَ: (وَإِذَا تَزَوَّجَ عَبْدٌ أَوْ أَمَةٌ بِغَيْرِ إِذْنِ الْمَوْلَى، ثُمَّ أُعْتِقَا - نَفَذَ النِّكَاحُ) ؛ لِأَنَّهُمَا مِنْ أَهْلِ الْعِبَارَةِ، وَالتَّوَقُّفُ لِحَقِّ الْمَوْلَى وَقَدْ زَالَ.
