قَالَ: (وَإِذَا أَسْلَمَتِ الْمَرْأَةُ وَوَالَتْ أَوْ أَقَرَّتْ بِالْوَلَاءِ وَفِي يَدِهَا ابْنٌ صَغِيرٌ تَبِعَهَا فِي الْوَلَاءِ) ، وَقَالَا: لَا يَتْبَعُهَا لِأَنَّهُ لَا وَلَايَةَ لَهَا عَلَى مَالِهِ فَعَلَى نَفْسِهِ أَوْلَى، وَلَهُ أَنَّهُ بِمَنْزِلَةِ النَّسَبِ وَهُوَ نَفْعٌ مَحْضٌ فَيَمْلِكُهُ عَلَيْهِ كَقَبْضِ الْهِبَةِ، وَاللَّهُ أَعْلَمُ.
