(وَلَوْ أَمَرَ غَيْرَهُ أَنْ يُزَوِّجَهُ حَنِثَ) لِأَنَّ الْوَكِيلَ فِي النِّكَاحِ سَفِيرٌ وَمُعَبِّرٌ عَلَى مَا عُرِفَ فِي مَوْضِعِهِ.

وَلَوْ قَالَ: عَنَيْتُ أَنْ لَا أَتَكَلَّمَ بِهِ صَدَقَ دِيَانَةً لِأَنَّهُ يَحْتَمِلُهُ لَا قَضَاءً لِأَنَّهُ خِلَافُ الظَّاهِرِ.
