قَالَ: (وَلَا يُحَدُّ مِنْ وُجِدَ مِنْهُ رَائِحَةُ الْخَمْرِ أَوْ تَقَيَّأَهَا) لِأَنَّ الرَّائِحَةَ مُشْتَبِهَةٌ وَاحْتِمَالُ أَنَّهُ شَرِبَهَا مُكْرَهًا ثَابِتٌ، وَالْحُدُودُ لَا تَجِبُ بِالشَّكِّ، وَاللَّهُ أَعْلَمُ.
