قَالَ: (وَإِذَا قُتِلَ الْمُكَاتَبُ عَنْ وَفَاءٍ وَلَهُ وَرَثَةٌ غَيْرُ الْمَوْلَى فَلَا قِصَاصَ أَصْلًا) لِاشْتِبَاهِ الْوَلِيِّ فَإِنَّهُ إِنْ مَاتَ عَبْدًا فَالْمَوْلَى وَلِيُّهُ فَإِنْ مَاتَ حُرًّا فَالْوَارِثُ وَلِيُّهُ، وَالْمَسْأَلَةُ مُخْتَلِفَةٌ بَيْنَ الصَّحَابَةِ - رَضِيَ اللَّهُ عَنْهُمْ - فَاشْتَبَهَ الْوَلِيُّ فَتَعَذَّرَ الِاسْتِيفَاءُ.
