(وَإِنْ قَتَلَهُ وَلِيُّ أَحَدِهِمْ سَقَطَ حَقُّ الْبَاقِينَ) ; لِأَنَّ حَقَّهُمْ فِي الْقِصَاصِ وَقَدْ فَاتَ، وَصَارَ كَمَا إِذَا مَاتَ الْقَاتِلُ فَإِنَّهُ يَسْقُطُ الْقِصَاصُ لِفَوَاتِ مَحَلِّهِ كَذَا هَذَا وَصَارَ كَمَوْتِ الْعَبْدِ الْجَانِي.
