بَابُ الْخِيَارَاتِ] ِ (خِيَارُ الشَّرْطِ جَائِزٌ لِلْمُتَبَايِعَيْنِ، وَلِأَحَدِهِمَا ثَلَاثَةَ أَيَّامٍ فَمَا دُونَهَا) وَالْأَصْلُ فِيهِ قَوْلُهُ - عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ - لِحَبَّانَ بْنِ مُنْقِذٍ وَكَانَ يُخْدَعُ فِي الْبِيَاعَاتِ:«إِذَا ابْتَعْتَ فَقُلْ لَا خِلَابَةَ، وَلِي الْخِيَارُ ثَلَاثَةَ أَيَّامٍ»
