قَالَ: (وَإِذَا تَسَلَّمَ الْعَيْنَ الْمُسْتَأْجَرَةَ فَعَلَيْهِ الْأُجْرَةُ وَإِنْ لَمْ يَنْتَفِعْ بِهَا) لِأَنَّ تَسْلِيمَ الْمَنْفَعَةِ غَيْرُ مُمْكِنٍ فَأُقِيمَ تَسْلِيمُ الْعَيْنِ مَقَامَهَا لِيَتَمَكَّنَ مِنْ الِانْتِفَاعِ.
