قَالَ: (وَإِنْ حَضَرَ وَارِثٌ وَاحِدٌ لَمْ يَقْسِمْ وَإِنْ أَقَامَ الْبَيِّنَةَ) لِأَنَّ الْوَاحِدَ لَا يَكُونُ خَصْمًا وَمُقَاسِمًا مِنْ جِهَتَيْنِ وَلَا بُدَّ مِنْ حُضُورِ خَصْمَيْنِ.
