(وَإِلَّا فُسِخَتِ الْقِسْمَةُ) لِاخْتِلَالِهَا، وَتُسْتَأْنَفُ لِأَنَّ الْمَقْصُودَ تَكْمِيلُ الْمَنْفَعَةِ، وَلَا يَتَأَتَّى ذَلِكَ إِلَّا بِالطَّرِيقِ وَالْمَسِيلِ.
