قَالَ: (وَكَذَلِكَ كَلُّ مُخْتَلِفَيِ الْمَنْفَعَةِ) كَسُكْنَى الدَّارِ وَزَرْعِ الْأَرْضِ،

وَكَذَا الْحَمَّامُ وَالدَّارُ، لِأَنَّ كُلَّ وَاحِدٍ مِنَ الْمَنْفَعَتَيْنِ يَجُوزُ اسْتِحْقَاقُهَا بِالْمُهَايَأَةِ، وَاللَّهُ أَعْلَمُ.
