وإن كان بينهما حائل طارئ وهو البناء ففيه وجهان احدهما لا يجتهد لانه في أي موضع كان فرضه الرجوع إلى العين فلا يتغير بالحائل الطارئ والثانى يجتهد وهو ظاهر المذهب لان بينه وبين البيت حائل يمنع المشاهدة فاشبه إذا كان بينهما جبل
