وان مات في اثناء الحول ففيه قولان (احدهما) ينقطع الحول لانه زال ملكه عنه فصار كما لو باعه (والثاني) لا ينقطع بل يبنى الوارث علي حوله لان ملك الوارث مبنى علي ملك المورث ولهذا لو ابتاع شيئا معيبا فلم يرد حتي مات قام وارثه مقامه في الرد بالعيب
