وإن أكل ناسيا فظن أنه أفطر بذلك ثم جامع عامدا فالمنصوص في الصيام انه لا تجب الكفارة لانه وطئ وهو يعتقد انه غير صائم فأشبه إذا وطئ وعنده انه ليل ثم بان انه نهار وقال شيخنا القاضى أبو الطيب الطبري رحمه الله يحتمل عندي انه تجب عليه الكفارة لان الذى ظنه لا يبيح الوطئ
