وان حلق رأسه وهو ساكت ففيه طريقان (احدهما) انه كالنائم والمكره لان السكوت لا يجرى مجرى الاذن والدليل عليه انه لو اتلف رجل ماله فسكت لم يكن سكوته اذنا في اتلافه (والثاني) انه بمنزلة ما لو اذن فيه لانه يلزمه حفظه والمنع من حلقه
