فاعتبر ابتداؤها من حين العقد كالاجل ولانه لو اعتبر من حين التفرق صار أول مدة الخيار مجهولا لانه لا يعلم متى يفترقان (والثانى) انه يعتبر من حين التفرق لان ما قبل التفرق الخيار ثابت فيه بالشرع فلا يثبت فيه بشرط الخيار
