(فإذا قلنا) بقوله القديم فهل تفتقر صحة البيع إلى ذكر الصفات أم لا فيه ثلاثة أوجه (أحدها) أنه لا يصح حتى تذكر جميع الصفات كالمسلم فيه (والثانى) لا يصح حتي تذكر الصفات المقصودة (والثالث) أنه لا يفتقر إلى ذكر شئ من الصفات وهو المنصوص في الصرف لان الاعتماد على الرؤية ويثبت له الخيار إذا رآه فلا يحتاج إلى ذكر الصفات *
