" ثُمَّ الْفُقَرَاءِ فَمَاتَ أَحَدُهُمَا فَنَصِيبُهُ لِلْآخَرِ " لَا لِلْفُقَرَاءِ لِأَنَّهُ أَقْرَبُ إلَى غَرَضِ الْوَاقِفِ وَلِأَنَّ شرط لانتقال إليهم انقراضهما جميعا. وَلَمْ يُوجَدْ وَالصَّرْفُ إلَى مَنْ ذَكَرَهُ الْوَاقِفُ أَوْلَى
