بِخِلَافِ أَبِيهِ الشَّقِيقِ كَمَا مَرَّ " وَعَمٌّ لِغَيْرِ أُمٍّ " أَيْ لِأَبَوَيْنِ أَوْ لِأَبٍ " كَأَخٍ كَذَلِكَ " أي لغير الأم اجْتِمَاعًا وَانْفِرَادًا فَمَنْ انْفَرَدَ مِنْهُمَا أَخَذَ كُلَّ التَّرِكَةِ وَإِذَا اجْتَمَعَا سَقَطَ الْعَمُّ لِأَبٍ بِالْعَمِّ لِأَبَوَيْنِ
