" وَلَوْ ادَّعَتْ نِكَاحًا وَمَهْرَ مِثْلٍ " بِأَنْ لَمْ تَجْرِ تَسْمِيَةٌ صَحِيحَةٌ " فَأَقَرَّ بالنكاح فَقَطْ " أَيْ دُونَ الْمَهْرِ بِأَنْ أَنْكَرَهُ أَوْ سَكَتَ عَنْهُ وَذَلِكَ بِأَنْ نَفَى فِي الْعَقْدِ أو لم يذكر فيه " كلف بيانا " للمهر لِأَنَّ النِّكَاحَ يَقْتَضِيهِ
