" فَلَا يَقَعُ " مِمَّنْ طَلَبَ مِنْ قَوْمٍ شَيْئًا فَلَمْ يُعْطُوهُ فَقَالَ طَلَّقْتُكُمْ وَفِيهِمْ زَوْجَتُهُ وَلَمْ يَعْلَمْ بِهَا خِلَافًا لِلْإِمَامِ وَلَا " مِمَّنْ حَكَى طَلَاقَ غَيْرِهِ " كَقَوْلِهِ قَالَ فُلَانٌ زَوْجَتِي طَالِقٌ وَهَذَا أَوْلَى مِنْ تَمْثِيلِهِ بِطَلَاقِ النَّائِمِ لِأَنَّ حُكْمَهُ عُلِمَ مِنْ اشْتِرَاطِ التَّكْلِيفِ فِيمَا مَرَّ
