فَصْلٌ: فِي الشَّكِّ فِي الطَّلَاقِ.

لَوْ " شَكَّ في " وُقُوعَ " طَلَاقٍ " مِنْهُ مُنَجَّزٍ أَوْ مُعَلَّقٍ كَأَنْ شَكَّ فِي وُجُودِ الصِّفَةِ الْمُعَلَّقِ بِهَا " فَلَا " يُحْكَمُ بِوُقُوعِهِ لِأَنَّ الْأَصْلَ عَدَمُ الطَّلَاقِ وَبَقَاءُ النِّكَاحِ " أَوْ فِي عَدَدٍ " كَأَنْ طَلَّقَ وَشَكَّ هَلْ طَلَّقَ وَاحِدَةً أَوْ أَكْثَرَ " فَالْأَقَلُّ " يَأْخُذُ بِهِ لِأَنَّ الْأَصْلَ عَدَمُ الزَّائِدِ عَلَيْهِ
