" فَإِنْ زَادَتْ " أَيْ الدِّيَةُ " عَلَى قِيمَتِهِ فَالزِّيَادَةُ لِوَرَثَتِهِ " لِأَنَّهَا وَجَبَتْ بِسَبَبِ الْحُرِّيَّةِ هَذَا كُلُّهُ إذَا لَمْ يَكُنْ لِجُرْحِهِ أَرْشٌ مُقَدَّرٌ وَإِلَّا فَلِلسَّيِّدِ الأقل من أرشه والدية كما يعلم ذَلِكَ مِنْ قَوْلِي
