فَصْلٌ: فِي كَفَّارَةِ الْقَتْلِ.

وَالْأَصْلُ فِيهَا قَوْله تَعَالَى:{وَمَنْ قَتَلَ مُؤْمِناً خَطَأً فَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ} ١ وَقَوْلُهُ: {وَإِنْ كَانَ مِنْ قَوْمٍ بَيْنَكُمْ وَبَيْنَهُمْ مِيثَاقٌ فَدِيَةٌ مُسَلَّمَةٌ إِلَى أَهْلِهِ وَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ} ٢.

تَجِبُ " عَلَى غَيْرِ حَرْبِيٍّ " لَا أَمَانَ لَهُ
