" وَلَوْ أَنْكَرَ مُدَّعًى عَلَيْهِ اللَّوْثَ " فِي حَقِّهِ كأن قال كُنْت عِنْدَ الْقَتْلِ غَائِبًا عَنْهُ أَوْ لَسْت أنا الذي رؤي مَعَهُ السِّكِّينُ الْمُتَلَطِّخُ عَلَى رَأْسِهِ " حَلَفَ " فَيُصَدَّقُ لِأَنَّ الْأَصْلَ بَرَاءَةُ ذِمَّتِهِ وَعَلَى الْمُدَّعِي الْبَيِّنَةُ.
