" وَلَوْ " مَرْهُونًا أَوْ مُكْتَرًى أَوْ " مَلَكَهُ قَبْلَ إخْرَاجِهِ " من الحرز بإرث وغيره بَلْ أَوْ قَبْلَ الرَّفْعِ إلَى الْقَاضِي " وَلَا بما " إذا " ادعى ملكه " لاحتمال ما ادعاه فيكون شبهة " ولا بماله فِيهِ شَرِكَةٌ " وَإِنْ قَلَّ نَصِيبُهُ مِنْهُ لِأَنَّ له في جُزْءٍ حَقًّا وَذَلِكَ شُبْهَةٌ وَلَا يُقْطَعُ بِمَا اتَّهَبَهُ وَلَوْ قَبْلَ قَبْضِهِ لِشُبْهَةِ اخْتِلَافِ الْمِلْكِ.
