"فَإِنْ أَقَرَّ" بِالْحَقِّ حَقِيقَةً أَوْ حُكْمًا " فَذَاكَ " ظَاهِرٌ فِي ثُبُوتِهِ " أَوْ أَنْكَرَ سكت أو قال للمدعي ألك حجة " . نَعَمْ إنْ عَلِمَ عِلْمَهُ بِأَنَّ لَهُ إقَامَتَهَا فَالسُّكُوتُ أَوْلَى أَوْ شَكَّ فَالْقَوْلُ أَوْلَى أَوْ علم جهله بذلك وجب إعلامه به
