" فَإِنْ اتَّحَدَا " أَيْ وَاجِبَا السَّيِّدِ وَالْمُكَاتَبِ جِنْسًا وصفة وَتَكْسِيرٍ وَحُلُولٍ وَأَجَلٍ وَكَانَا نَقْدَيْنِ فَهُوَ أَوْلَى مِنْ قَوْلِهِ فَإِنْ تَجَانَسَا " فَالتَّقَاصُّ " وَاقِعٌ بَيْنَهُمَا كَسَائِرِ الدُّيُونِ مِنْ النُّقُودِ الْمُتَّحِدَةِ كَذَلِكَ بِأَنْ يسقط من أحد الديتين بِقَدْرِهِ مِنْ الْآخَرِ
