" وَإِلَّا " أَيْ وَإِنْ لَمْ يَبْدُ صَلَاحُهُ " فَإِنْ بِيعَ وَحْدَهُ " أَيْ دُونَ أَصْلِهِ " لَمْ يَجُزْ " لِلْخَبَرِ الْمَذْكُورِ " إلَّا بِشَرْطِ قَطْعِهِ " فَيَجُوزُ إجْمَاعًا بِشُرُوطِهِ السَّابِقَةِ فِي الْبَيْعِ مِنْ كَوْنِهِ مَرْئِيًّا مُنْتَفَعًا بِهِ إلَى غَيْرِ ذَلِكَ
