(وان نزل) الأقرب فالأقرب كالأصول ثم شقيقها ثم أخوها لأبيها (وهكذا) يقدم الأقرب فالأقرب (على ترتيب الميراث) ولا يلى بنو أب أبعد مع بنى أب أقرب ولا غير العصبات كالأخ من الأم ونحوه،
