(وَكَذَا كُلُّ مَا كَانَ إتْلَافًا لِلْمَالِ أَوْ) كَانَ (تَمْلِيكًا) لِلْمَالِ (بِغَيْرِ عِوَضٍ) - لِأَنَّ الشَّرِكَةَ وُضِعَتْ لِلِاسْتِرْبَاحِ وَتَوَابِعِهِ، وَمَا لَيْسَ كَذَلِكَ لَا يَنْتَظِمُهُ عَقْدُهَا.
