(وَكَذَا) الْحُكْمُ (إنْ) كَانَ لِلْمَدْيُونِ عَلَى أَحَدِهِمَا دَيْنٌ قَبْلَ وُجُوبِ دَيْنِهِمَا عَلَيْهِ حَتَّى (وَقَعَتْ الْمُقَاصَّةُ بِدَيْنِهِ السَّابِقِ) لِأَنَّهُ قَاضٍ لَا قَابِضٌ.
