(قَوْلُهُ: لِمُخَالَفَتِهِ لِلشَّرْعِ) وَهُوَ مَا رُوِيَ أَنَّ «عَائِشَةَ - رَضِيَ اللَّهُ تَعَالَى عَنْهَا - أَرَادَتْ أَنْ تَشْتَرِيَ بَرِيرَةَ لِتُعْتِقَهَا فَقَالَ أَهْلُهَا: عَلَى أَنَّ وَلَاءَهَا لَنَا فَقَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ تَعَالَى عَلَيْهِ وَسَلَّمَ - لَا يَمْنَعُكِ ذَلِكَ فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ» أَتْقَانِيٌّ.
