(وَعَنْهُ: لَا يَحْرُمُ وَطْؤُهَا إِذَا كَانَ التَّكْفِيرُ بِالْإِطْعَامِ، اخْتَارَهُ أَبُو بَكْرٍ) وَأَبُو إِسْحَاقَ، وَقَالَهُ أَبُو ثَوْرٍ ; لِأَنَّ اللَّهَ لَمْ يَذْكُرِ الْمَسِيسَ فِيهِ كَمَا ذَكَرَهُ فِي الْعِتْقِ وَالصِّيَامِ. وَجَوَابُهُ أَنْ يُحْمَلَ الْمُطْلَقُ عَلَى الْمُقَيَّدِ لِاتِّحَادِ الْوَاقِعَةِ.
