(وَعَنْهُ: لَا يَصِحُّ) لِأَنَّهُ حِينَ الْمَوْتِ وَارِثٌ، وَكَمَا لَوْ أَقَرَّ لِوَارِثٍ بِمَالٍ.
وَجَوَابُهُ هُنَا: إِقْرَارٌ بِمَالٍ مِنْ طَرِيقِ الْحُكْمِ، وَهُنَاكَ مِنْ طَرِيقِ الصَّرِيحِ، وَالْأُصُولُ فَرَّقْتَ بَيْنَ الْإِقْرَارَيْنِ.
