شرح منتهى الإراداتal-Buhuti

(وَإِنْ أَرَادَهُ) أَيْ: الطَّمَّ لِغَرَضٍ صَحِيحٍ (مَالِكٌ أُلْزِمَ) غَاصِبٌ (بِهِ) أَيْ: الطَّمِّ لِعُدْوَانِهِ، وَلِأَنَّهُ يَضُرُّ بِالْأَرْضِ

معونة أولي النهىIbn al-Najjar

(وإن أراده) أي: أراد طمها من الغاصب. (مالك: الزم) الغاصب (به) أي: بالطم؛ لوجود الحفر عدواناً.

ولأنه يضر بالأرض.
