(وإن ادَّعى العدل دفعَ الثمن إلى المُرتَهِن، فأنكر) المُرتَهِن أخذه (ولم يكن) العدل (قضاه ببينة، ولا حضور راهن؛ ضمن) العدل؛ لتفريطه في القضاء بغير بينة (كما لو أمره) الراهن (بالإشهاد فلم يفعل) أي: يشهد
