(وإن عُلم) مالكه (ولم يُعقِب) أي: لم يكن له ورثة (لم يملك) أيضًا بالإحياء؛ لحديث عائشة ترفعه:"مَن أحيا أرضًا ليست لأحدٍ" (وأقطعه الإمام من شاء) لأنه فَيْء.
