واختلفوا هل تنعقد صفته قبل الملك؟ واختلفوا هل تنعقد صفته قبل الملك؟ فقال أبو حنيفة: يصح ويلزم سواء أطلق أو عمم أو خصص أو عين من قبيلة أو بلدة أو امرأة بعينها ولا يلزم إذا عم أو أطلق وكذلك مذهبهم في انعقاد صفة العتق قبل الملك إلا أحمد فإنه عنه في العتق روايتين.
