مسألة: الشفعة موروثة، خلافا لأبي حنيفة؛ لقوله صلى الله عليه وسلم: (من ترك مالا أو حقا فلورثته) ، ولأنه خيار ثبت لدفع الضرر عن ماله، فجاز أن يقوم الوارث مقامه كخيار الرد بالعيب، ولأنه حق مستفاد بالملك، فجاز أن يورث كثمار الشجر ونتاج الماشية.
