مسألة: إذا تزوجت الأم ودخل الزوج بها سقطت حضانتها، خلافا لما يحكى عن الحسن؛ لقوله صلى الله عليه وسلم: «أنت أحق به ما لم تنكحي» ولأنه يلحق الضرر بالصبي بكونه مع زوج أمه ويلحق أباه أيضا فكان [له] إزالته عنه.
