مسألة: الأذان مسنون وليس بمفروض، خلافا لداود في قوله: إنه واجب في الجماعة، لأنه نداء بالصلاة كالإقامة، ولأنها صلاة تؤدى، فلم يكن الأذان واجبا فيها كالمؤداة في الانفراد ولأن الجماعة تؤثر في إسقاط النطق الواجب في الصلاة، وهو القراءة فكانت عن أن يوجب غيره أبعد، اعتبارا بأدائها في السفر، ولأنها صلاة شرعية كالفوائت.
