مسألة: إذا ابتاعها حاملا ففيها روايتان؛ فوجه قوله: إنها تكون أم ولد قوله: «أيما أمة ولدت من سيدها» فعم، ولأنه قد ثبت له حرمة الحرية من جهة أبيه حال الحمل، فسرى ذلك إلى أمه، أصله لو ابتدأ الحمل في ملكه، ووجه قوله لا تكون أم ولد: أنه حمل خلق رقيقا كمن ابتاعها بعد الوضع.
