مسألة: إذا رأى الهلال وحده لزمه الصوم. خلافا لبعض التابعين في قولهم: إنه لا يلزمه إلا بحكم الإمام لقوله عز وجل: {فمن شهد منكم الشهر فليصمه}، وقوله - صلى الله عليه وسلم -: (صوموا لرؤيته وأفطروا لرؤيته) ، وهذا قد رآه، ولأنه لما لزمه الصوم بشهادة غيره وهي مظنونة له، كان بأن يلزم برؤيته المتحققة أولى.
