مسألة: وصيد الحرم مضمون بالجزاء على الحلال والحرام. خلافا لداود. لقوله تعالى: {لا تقتلوا الصيد وأنتم حرم} . وهذا يتناول الحرام بالإحرام والحرم. ولأنه يسمى محرما لكونه في الحرم، فإذا ثبت ذلك فكل معنى يسمى به محرما فمتى قتل الصيد فيه كان مضمونا بالجزاء كالإحرام.
