سُقُوطُ الْحُدُودِ بِمَوْتِ الشُّهُودِ: ١٥ - يَسْقُطُ حَدُّ الرَّجْمِ خَاصَّةً بِمَوْتِ الشُّهُودِ - عِنْدَ مَنْ يَشْتَرِطُونَ لإِِِقَامَةِ الْحَدِّ الْبِدَايَةَ بِالشُّهُودِ وَهُمُ الْحَنَفِيَّةُ - لأَِنَّ بِالْمَوْتِ قَدْ فَاتَتِ الْبِدَايَةُ عَلَى وَجْهٍ لاَ يُتَصَوَّرُ عَوْدُهُ، فَسَقَطَ الْحَدُّ ضَرُورَةً (١) .
