سُقُوطُهُ وَانْتِقَالُهُ: ٥ - خِيَارُ النَّقْدِ يُمَاثِل خِيَارَ الشَّرْطِ فِي أَسْبَابِ السُّقُوطِ وَأَحْكَامِهِ، وَكَذَلِكَ انْتِقَالُهُ، فَهُوَ لاَ يُورَثُ عِنْدَ الْحَنَفِيَّةِ أُسْوَةً بِخِيَارِ الشَّرْطِ (أَصْلُهُ) (٢) ، وَتَفْصِيل ذَلِكَ فِي مُصْطَلَحِ: (خِيَارُ الشَّرْطِ) . صُورَةٌ مَشْهُورَةٌ مِنْ خِيَارِ النَّقْدِ (بَيْعُ الْوَفَاءِ) .
